Under the present End User License Agreement (hereinafter referred to as EULA) Recogmission® LLC, a legal entity incorporated and existing in accordance with the laws of the Russian Federation, having its registered office at: Michurina str., 21b, Samara, 443013, Russia (hereinafter referred to as Recogmission®) provides You with the Picollator Plugin (hereinafter referred to as Picollator Plugin or the Software). Picollator Plugin is based on the solution for automatic finding and indexing multimedia files according to the content itself by Recogmission®.

By installing the Software You signify Your irrevocable acceptance of this EULA. You also agree to ensure that anyone who uses this Software on Your computer also abides by the EULA. Recogmission® has the right to revise the EULA at any time without providing notice to its users. Your continued use of the Software shall be deemed irrevocable acceptance of those revisions.

Licensed Uses and Restrictions.

Recogmission® grants You a royalty-free, non-exclusive and non-transferable open-ended license to use the Software, from the date You install the Software on Your computer, on the terms and conditions set forth herein.

This EULA defines legal use of the Picollator Plugin, all updates, revisions, substitutions, and any copies of the Picollator Plugin made by or for You. All rights not expressly granted to You are reserved by Recogmission®, unless applicable law gives You more rights despite this limitation.

You may not distribute, share, sell, lease, or otherwise make available the Software or any applications that include the Picollator Plugin to third parties, without prior consent of Recogmission®. You also may not or reverse engineer, decompile, or disassemble any sample software provided under this EULA.

You agree that Recogmission® and its web sites will be the sole download and distribution point for Your Software.

Use of Picollator Plugin and Search Results

You may apply Picollator Plugin for Your personal, non-commercial use.

Some pictures, documents or any other information You can obtain via use of the Picollator Plugin can contain mature or adult content intended for people who are at least 18 years old. If You view this adult content, we understand that You are telling us that You are at least 18 years old and that the material You are viewing is acceptable to You. So, You understand, that You are fully responsible for the quality and subject-matter of any images You use for search with Picollator Plugin.

In relation with the constant web changes, there is no searching or indexing technology which can include all pages accessible on the web. As a result, use of Recogmission®’s Picollator Plugin does not and cannot guarantee that Your search results will be complete or accurate.

You understand that Your use of Picollator Plugin (including any download of the information found by the use of Picollator Plugin) is at Your own risk.

You understand that all information and other content (including third party information, images, or other content) found by the use of Picollator Plugin (particularly via the search results), are provided on an "as is" "where-is" and "where available" basis, and are subject to change at any time without notice to You.

You also understand that search results (any information, including images and other content) found by the use of Picollator Plugin aren’t Recogmission®’s property.

You understand that information (including images and any other content) found by the use of Picollator Plugin may be protected by intellectual property rights which are owned by the persons or companies who provide that information (images, etc.) in the Internet (or by any other persons or companies on their behalf).

So, You are aware, that You may not modify, rent, lease, loan, sell, distribute, etc. this information (either in whole or in part) unless You have been specifically informed that You may do so by the owners of that information, in a separate agreement etc.

You are also informed that under privacy and other laws of some countries use of certain images (e.g. portraits etc.) can be forbidden by persons (authorities etc.) represented in such pictures. That is why You understand that any use such images without prior consent of such persons are at Your own risk.

Applicable Law

This EULA will be governed by the laws of Russian Federation, without reference to conflict of laws principles. You agree that any litigation relating to this EULA may only be brought in, and shall be subject to the jurisdiction of any court of Russian Federation.

This EULA is made in Russian and English versions. In case of any discrepancies of the texts in English and Russian, Russian text shall prevail.

Disclaimer of warranty.

The Software is licensed “as-is.” You bear the risk of using it.

Recogmission® warrants that the Software will provide the features and functions generally described on our website when You download it.

We have taken all reasonable steps to keep the Software free of viruses, spy ware, or any other harmful code. We will not track or collect any personal or any other information about You, Your data, or Your use of the Software except of the following:
(a) You specifically authorize us to do it;
(b) statistic data we need to improve our Software and services (i.e. non-personalized information on our users countries, number of Your requests, etc.)

We do not warrant that the Software or Your ability to use it will be uninterrupted or error-free. To the extent permitted under Your national laws, Recogmission® excludes the implied warranties of merchantability, fitness for a particular purpose and non-infringement. This Software is not intended for use in mission-critical activity or on computing hardware that also contains mission-critical information.

Limitation of liability

Recogmission® shall not, under any circumstances, be liable to You for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with use of Picollator Plugin, whether based on breach of contract, breach of warranty, tort (including negligence, product liability or otherwise), or any other pecuniary loss, whether or not Recogmission® has been advised of the possibility of such damages.

Picollator Plugin, and also Picollator® and Recogmission® trademarks are Recogmission®’s property and are protected by Russian and international copyright, patent, trademarks laws and other applicable intellectual property laws.

In cases not provided for by the present EULA the relations between You and Recogmission® shall be governed by the Picollator® Online web site Terms of Service, which You can find at http://www.picollator.com/tos.

If any part of this EULA is found to be invalid or unenforceable, the remaining terms will stay in effect.
